These Terms and Conditions (“Terms”) govern your use of INSIM GOLF’s website, services, memberships, and facilities, operated by INSIM GOLF Pty Ltd (“INSIM GOLF,” “we”, “us”, “our”). By accessing our website, purchasing a membership, or using our services, you agree to be bound by these Terms. If you do not agree, you must refrain from using our services.
Membership Commitment
- All memberships (not including corporate memberships or 12month upfront payment memberships) require a minimum 12-week commitment, billed according to the selected payment option.
- Corporate Memberships require a 12-month commitment, paid upfront in full at the time of registration, or billed according to the selected payment option.
- Foundation Members receive a 15% discount off the current Standard Premium membership rate, provided they renew without lapse. If a Foundation Member allows their membership to lapse, they will revert to the Standard Premium rate at the time of rejoining, with no discount applied.
- After the initial term, cancellation requires 30 days’ written notice, submitted via email or our contact form.
- Memberships begin on the date of purchase and continue until cancelled or expired.
- Membership benefits are non-transferable, unless explicitly stated.
- Members may book one bay per day for one hour(pending membership category). Additional hours may be purchased subject to availability.
- Simulator bookings must include the member as an active participant.
- Multi-bay bookings are not permitted under any membership tier unless explicitly approved by INSIM GOLF management.
Pausing memberships
- Maximum 1 month membership pause option available at discretion of InSim Golf.
- request must be made in writing via email or request form 1 week in advance to the start of the Paused time
- only 1 pause option period allowed within a 12-month period
Guest Access
- Members may bring up to three (3) guests per session, subject to booking availability and guest registration.
- The member must be present and actively participating in the session for guest access to be valid.
- Guests are charged at the member’s guest rate per person / per hour, unless otherwise stated.
- Members are fully responsible for their guests’ conduct, payment, and adherence to INSIM GOLF policies.
- Any misconduct, damage, or breach of policy by a guest will be treated as the responsibility of the hosting member and may result in disciplinary action, including suspension or cancellation of membership without refund.
Conduct and Behaviour
INSIM GOLF is a shared space built on trust, professionalism, and community. All members and guests must:
- Follow all safety instructions and behave respectfully while on premises.
- Refrain from disruptive, offensive, or inappropriate behaviour toward staff, members, or guests.
- Not allow unauthorised individuals to enter the premises (“tailgating” is strictly prohibited).
- Pay for all food and beverages consumed via QR code or counter service.
- Understand that misconduct, theft, or breach of policy may result in suspension or cancellation of membership without refund.
Our facilities are monitored by 24/7 CCTV and a back-to-base security system, including duress alarms. Activation of a duress alarm will notify emergency services immediately.
Facility Access and Usage
- Access is restricted to designated members-only hours, which may vary by membership tier and are subject to change with notice.
- INSIM GOLF reserves the right to modify equipment, layout, pricing, and access with reasonable notice.
- Use of facilities may be restricted due to lessons, corporate bookings, or events.
- Bay booking cancellations must be made at least 24 hours in advance. Late cancellations or no-shows may result in a fee or temporary booking restrictions at INSIM GOLF’s discretion. Use of equipment is at your own risk. You must report any damage or malfunction immediately.
- You may not use the facility for coaching, commercial activity, or group events without prior written approval.
- Social play is only permitted during staffed hours, which may vary from day to day. INSIM GOLF reserves the right to adjust staffed hours without notice. Access outside staffed hours are strictly prohibited for non-members. Members wanting restricted hours access booking are required to book in advance through InSim Golf staff for availability and access.
Payment Terms
- Payment may be made via credit card, direct debit, or other approved methods.
- Weekly billing may incur administration and signup fees.
- Failed payments may result in suspension of access until resolved.
- By authorising payment, you agree to allow INSIM GOLF to debit your nominated account according to your selected payment option.
Products and Services
- Products and services offered online, or in-store are subject to availability and change.
- We strive to display accurate product information but cannot guarantee colour or image accuracy across devices.
- We reserve the right to:
- Limit sales by region, customer type, or quantity.
- Discontinue products or services at any time.
- Reject orders due to pricing errors, suspected fraud, or unavailable stock.
- All purchases are subject to our Refund Policy.
Privacy and Data Protection
Your personal information is collected and managed in accordance with our Privacy Policy. We collect data to:
- Process bookings, payments, and memberships
- Communicate with you about sessions, promotions, or account updates
- Improve our services and comply with legal obligations
We do not sell or rent your personal information. Credit card data is encrypted during transmission. You may request access or correction of your personal data at any time.
Prohibited Uses
You may not use our site or services for:
- Illegal activities or solicitation
- Harassment, discrimination, or abuse
- Intellectual property infringement
- Transmitting malware or harmful code
- Circumventing security features or allowing unauthorised access
Violation may result in immediate termination of access.
Liability and Indemnity
All services and products are provided “as is” without warranties. INSIM GOLF is not liable for any direct, indirect, incidental, or consequential damages arising from your use of our services or facilities, except as required by law.
You agree to indemnify INSIM GOLF against claims arising from breach of these Terms or misuse of services.
Limitation of Liability and Waiver of Claims
To the fullest extent permitted by law:
- INSIM GOLF Pty Ltd, its directors, officers, employees, contractors, agents, and affiliates (“INSIM Parties”) shall not be liable for any injury, loss, damage, claim, or expense (including indirect, incidental, special, or consequential damages) arising from your use of INSIM GOLF’s services, facilities, website, or equipment, whether based in contract, tort (including negligence), statute, or otherwise.
- You acknowledge and accept that participation in golf simulation, training, and related activities involves inherent risks, and you voluntarily assume all such risks.
- You agree to release, waive, and discharge the INSIM Parties from any and all claims, demands, actions, or causes of action that may arise from your use of INSIM GOLF’s services or premises, including but not limited to personal injury, property damage, or financial loss.
- You further agree not to bring any legal action or proceeding against INSIM GOLF or its personnel in relation to such claims, except where prohibited by law.
This clause does not exclude, restrict, or modify any rights you may have under the Australian Consumer Law, including guarantees that cannot be excluded.
Changes to Terms
We may update these Terms at any time. The latest version will always be available on our website. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved under applicable Australian jurisdiction.
